Terms & Conditions

Offer: This quotation is to sell goods and/or services as described within its text.

Complete Agreement: These terms and conditions as stated, constitute a complete agreement.  No modifications and/or changes can be made without written consent of both parties.

Payment: Payment is due on receipt of invoice.  Credit will be extended to the purchaser if a credit application has been previously completed and approved.  In the event of non-approval of the credit application, the purchaser will be on a C.O.D. basis.

Taxes: The price quoted does not include taxes of any type.  The purchaser shall pay all taxes that are applicable to the performance of the contract unless a suitable Tax-Exempt Certificate is furnished.

Work Hours: Normal work hours are 7:00AM – 3:30PM, Monday – Friday.  All other times constitute over-time and will be billed at rates applicable to the time and type of work performed.

Limitations of Liability:

1. Any and all claims (excluding death or bodily injury) from this, or extension of the contract, shall be limited to the purchase price as started. If no price is stated – as in work done on a time and material basis, the limit of liability shall be limited to the value of the work done to date.  All liability shall be terminated at the end of the warranty period.
2. Under no circumstances shall High Voltage Electric Service, Inc. be liable for special, exemplary, incidental, or consequential damages arising from this contract or any extension thereof. This limitation to special, exemplary, incidental, or consequential damages also includes, but is not limited to, loss of equipment use, loss of profit, loss of revenue, loss of any associated equipment, cost of power, rentals, cost of temporary equipment, power, facilities, and downtime.

Delay in Performance: High Voltage Electric Service, Inc. cannot be liable for delays in completing the scope of work due to: Acts of God, causes beyond its control, willful or negligent acts of the purchaser, labor disturbances, civil or military authorities, war, riot, fires, and strikes.  If work is delayed due to, but not limited to, the items listed, the contract completion date will be extended by an equal number of days or hours.  If the delay is caused by an act of the purchaser or because of a delay or prerequisite work done by others, High Voltage Electric Service, Inc. shall be entitled to reimbursement and/or price adjustment for expenses incurred due to this delay.

Warranty: High Voltage Electric Service, Inc. warrants to the purchaser that the work described in the quotation shall be performed in a professional and workman-like manner.  This work shall be free from defects in material and workmanship for a period of one (1) year from Date of Completion of work.  All claims during this period shall be promptly made in writing to High Voltage Electric Service, Inc.  High Voltage Service, Inc. will, at its own discretion, repair, replace, or re-perform the work as needed to correct the claim.
